BOISE, Idaho — The Idaho Supreme Court has denied Thomas Creech’s emergency request to stop his execution scheduled for next month.
In the motion, Creech wanted to delay the execution date as he and his attorney developed arguments for an appeal. The Idaho Supreme Court determined Creech has had ample time to develop appeal arguments since his botched execution in February.
The court also said it cannot stop an execution that is still under appeal and appeals do not require extending the timeline.
This is one of the ways Thomas Creech was trying to stop his execution. The other way is a writ of habeus corpus in federal court that is still pending.
